1. Acceptance of Terms

By accessing or using Foza ("Service", "Application", "we", "us"), including via web or mobile applications, you agree to be bound by these Terms of Service ("Terms").

If you do not agree with these Terms, you must not use the Service.

2. Description of the Service

Foza is an AI-powered companion chat application that allows users to interact with virtual AI characters ("Companions") based on predefined scenarios, personalities, and fictional contexts.

• Companions are artificial intelligence, not real humans
• Conversations are generated automatically by AI models (e.g., OpenAI, Google Gemini, or similar providers)
• The Service is intended for entertainment, companionship, and interactive experiences only

3. Eligibility & Age Requirements

• You must be at least 13 years old to use the Service
• Users between 13–17 years old must have parental or legal guardian consent
• The Service is not intended for children under 13

We reserve the right to restrict or terminate accounts that do not meet age requirements.

4. User Account Responsibilities

You agree to:

• Provide accurate and lawful information
• Maintain the security of your account credentials
• Be responsible for all activities under your account

You are solely responsible for content you submit and interactions you initiate.

5. Subscription, Credits & Payments

The Service may offer:

• Free plans with limited credits
• Monthly recurring subscriptions (Plus Plan)
• Prepaid or credit-based packages

Billing & Renewal

• Subscriptions automatically renew on the same day each month unless canceled
• You will be charged at the beginning of each billing cycle for the upcoming month
• Payment method on file will be charged automatically. Ensure payment details are current
• If payment fails, we will attempt to charge again. Repeated failures may result in service suspension
• Credits renew monthly and do not roll over to the next billing cycle

Cancellation

• You may cancel your subscription at any time through your account settings or the platform where you subscribed (App Store, Google Play, or web)
• Cancellation takes effect at the end of the current billing period. You will retain access until then
• No partial refunds are provided for unused time in the billing cycle
• After cancellation, your account will revert to the free plan with limited credits

Refund Policy

• All subscription fees are non-refundable, except where required by law
• We do not provide refunds for partial months, unused credits, or early cancellations
• Refunds may be granted at our sole discretion in cases of billing errors or technical issues preventing service access

Changes to Pricing

• We reserve the right to modify subscription prices, credit allocations, or plan features with at least 30 days' notice
• Price changes will not affect your current billing cycle. New prices take effect at your next renewal
• Existing subscribers may be grandfathered into their current pricing for a limited time, at our discretion
• Continued use of the Service after price changes constitutes acceptance of the new pricing

You are responsible for managing subscriptions through the platform where you subscribed (App Store, Google Play, or web).

6. AI & Fiction Disclaimer (CRITICAL)

You acknowledge and agree that:

• AI companions are fictional and simulated
• They do not possess emotions, awareness, or real-world intent
• Responses may be inaccurate, fictional, or misleading
• Conversations do not represent real relationships

The Service does NOT provide:

• Medical or mental health treatment
• Psychological counseling or therapy
• Legal, financial, or professional advice

❗ Do not rely on AI responses for real-life decisions.

7. Emotional & Mental Health Disclaimer

While the Service may include emotional or romantic-style conversations:

• It is NOT a substitute for human relationships
• It is NOT a mental health service
• Users experiencing distress, loneliness, or emotional dependency should seek help from qualified professionals or local support services

We are not responsible for emotional outcomes resulting from AI interactions.

8. Romantic / Affectionate Content Policy

The Service may include:

• Text-based affectionate or romantic dialogue
• Emotional companionship roleplay

The Service strictly prohibits:

• Pornographic or sexually explicit content
• Sexual content involving minors
• Visual sexual content (images, videos)
• Extreme fetish, violent, or exploitative content

We reserve the right to moderate or restrict content at our discretion.

9. Prohibited Use

You agree NOT to:

• Use the Service for illegal activities
• Generate hate speech, harassment, or threats
• Attempt to manipulate, exploit, or reverse-engineer AI systems
• Circumvent safety, moderation, or usage limits
• Upload malware or harmful code

10. User Content & License

You retain ownership of text you submit ("User Content").

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to:

• Process content to provide the Service
• Improve AI quality, safety, and moderation (anonymized where feasible)

11. Intellectual Property

All software, AI characters, scenarios, branding, and content belong to Foza.

You may not copy, reproduce, or distribute any part of the Service without permission.

12. Termination & Suspension

We may suspend or terminate your account if:

• You violate these Terms
• Required by law
• Necessary to protect users or the Service

Termination does not entitle refunds.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "AS IS"
• We are not liable for emotional distress, data loss, or damages arising from AI-generated content
• Total liability shall not exceed fees paid in the last 12 months

14. Governing Law

These Terms are governed by the laws of Singapore, without conflict-of-law principles.
